Driver charged with felony assault for threatening photographer with his vehicle

Yesterday, we showed you a video of a somewhat agitated driver harassing automotive photographer Alex Stone, who he felt was trespassing on his “private driveway” (which police have confirmed was actually a public road), with his truck.
Police were quick to take action and have now identified and arrested 52 year old Mark Gordon as the driver of the vehicle. As well as being charged with misdemeanour battery and vandalism, Gordon is facing a felony charge of Assault with a Deadly Weapon.
Here’s the video again, in case you missed it. There is some rather strong language, though, so you might want to use headphones or turn your speakers down.
I have to give maximum respect to Alex, here. I don’t think I could’ve remained anywhere near as calm as he did faced with a situation like this.
If convicted, Assault with a Deadly Weapon that isn’t a firearm can carry with it a prison sentence of up to four years, and counts as one of your “three strikes“. If he has other strikes, he may be looking at a much, much harsher sentence.

So, remember, folks. Photography is not a crime, but intentionally driving into photographers (or anybody else, for that matter) with your car is!
My thoughts on broadly sweeping “three strikes” laws aside, it’s nice to actually see somebody being held to account over harassing and threatening photographers in the middle of completely legal activities.

Not really. If this is a first offense a good attorney will wrangle it all down to just the misdemeanors and he will get off with a stiff fine and nothing more. He will still likely shell out over fifteen grand between the fines and attorney fees before this is all over and hopefully it will get his attention but I honestly doubt it. He’s an ass to the bone and such people don’t change.

As for the driver, he could have gotten them off “his driveway” simply by asking nicely. if he is found guilty of the charges (how can he not) a felonly holds some pretty long term ramifications. No sympathy or patience for people like that. Let’s see how tough he is if he spends even a few days behind bars with some real tough guys. He’d be on their turf now. Karma.

At 6’4″ and at least 220lbs (obviously an old drivers license) and in the middle of nowhere, the driver thought he could simply bully the photo team. I’m sure this isn’t the first time the driver has done this… Can you believe someone is married to that?
The felony charge should stick.. Especially because it’s all on video. If the driver had a gun instead of a truck and tried shooting the photographer, and missed, you bet that would be a felony charge… That truck is definitely a deadly weapon…

I feel relieved that there will likely be consequences for what this guy did. It’s hard not to watch the video and think that the outcome could have been much worse. There should be no tolerance for this type of behavior.
Were I in this situation, a call to 911 would have been made immediately after the initial interaction with this nut job.

said showed extreme patience let’s not say that he was doing something legal.
He was blocking a roadway which I am sure he is not allowed to do and would not
be able to get a permit to do so. That is probably why in the beginning he said
no need to call the police but this jerk in the truck is a hot head that saw
some young guys impeding his day. Very smart to have recorded everything and
being calm and not making things worst which shows them in the video trying to
be compliant but this jerk would not have any of it. Good for you guys.

I was there, though not in the video. From the first second, he was going crazy – and it was completely unprovoked. Alex was cool as a cucumber and respectful from start to finish. He gave the guy 20 chances to regain his composure – to no avail. I’m almost positive that this guy has a history of this sort of thing. Nobody acts like that out of the blue.

Charging someone with assault with a deadly weapon implys that they have actually hit the person with a weapon. In this case he clearly hit nobody.
Incorrect. Assault is causing someone to fear being injured. Battery is the act of injury. Hence why you have “Assault and Battery” as a charge. He committed assault in the act of attempting to hit/intimidate the person holding the camera.

that guy was having a bad day lol, but it’s a state road, right?….the photographer’s are required to pull a permit and probably hire a couple cops to stop traffic safely both directions. The Audi was clearly in the middle of the road (look back at the footage). Sorry, not trying to be a dick, but every highway job I shoot, this is the case. It’s the law…EVEN if they were on the side of the road, you wanna have cops for situations like this. I see TOTALLY OUT OF CONTROL PEOPLE every job I shoot. About 1 outta 50 pedestrians get REALLY mad at us (the film crew)….like crazy mad.
There’s no permit required to take photographs on public property, unless it’s posted otherwise, such as at a rock concert on public lands. The issue is if the parked car was impeding traffic or presenting a hazard in some way. Clearly it wasn’t the best parking job in the world, but given that it was a nearly deserted rural road and the car wasn’t jutting out into the street all that much I doubt the local police would care.
That’s correct, but you can’t be on the road. That Audi was clearly on the road. I’d be shocked if the local or state police didn’t require a permit, even if it was in bumfuk. It’s a state/county road, not private property. When a dipshit like this guy come along (and the do every shoot) our location mgr shows permits or the cops handle it. It’s best to stay away from the nuts. The guy could have pulled a gun.
Permit or no permit, if you feel someone is breaking the law then call the police.. It is not his job to determine if they are breaking the law, or enforce the law.. No excuse to behave the way he did, and I am glad he is being held accountable for his actions..

To reiterate, there is no permit required to take photographs on public property. If you’re putting up a movie set, that would be a different animal altogether, but these guys were not doing that.
at :27 seconds, there is an angled white Audi completely blocking a lane. You’re telling me that doesn’t require a permit? It’s not private property…it’s a county road.
If they had been setting up lights and scrims and silks and tripods blocking the lane on a public road then, yes, that would require a permit (assuming it’s a commercial shoot). One car, easily moved, encroaching on the lane is a ticket. As a member of a broadcast network news crew, I set up on the side of public roads and highways all the time (with lights and silks and tripods) without the need for a permit, or cops.
In any case, this yahoo and his SUV decided to take the law into his own hands and committed a felony.

Sometimes photography is a crime. As a stalking victim and rape survivor who has been assaulted by people using photography to get close to me and track me, I am sick to my stomach if a stranger starts photographing me. I would never physically attack someone, but if a “photographer” was following me or showed up at my house I would defend myself and report the harassment to the police. Just ask permission, and if someone tells you to get out of their driveway then just go.
Nobody was following him nor interested in photographing him.
I would totally respect your discomfort and refrain from shooting photos of you if asked. Just so you know.
And since it wasn’t his driveway…it wasn’t his place to demand them to leave a public place where they were shooting nothing more than a vehicle that was clearly worth a good few grand more than his vehicle.

Except the photographer wasn’t in a ‘driveway’. No permission is needed on a public road. And if you don’t want to be videotaped breaking the law and attempting murder than I suggest don’t give someone a reason to record it… just saying…

I’m not trying to be a jerk or anything; I really want to know what are the rules or laws I guess you can say, about stopping in the middle of the road(I saw the photographers car on the side yes but the subject, which I take was the other car, was on the middle(not blocking both lanes)I mean the middle of the one lane. Are we allowed to do that if it’s public and we don’t stop traffic?

i would have pulled out my steel baton if he got out of the car and if he tried to touch me, I would break his freakin arm… but if he came right towards me with the car, I would have pulled my gun and made him go away and may have even shot him. A suggestion though, it may or may not matter. My brother in-law used to do car shoots like that and they always pulled permits to shoot in the road. Granted they could be at it for quite a while, not something adhoc like it looked you were doing. If you’re going to do it though, get safety vests, set out cones, flashing yellow lights, etc… It might help, and it makes you look a bit more official.
Kinda hoping the picture takers take this a long ways. They will have input with the da as far as prosecution. If he has previous charges for shit like this make him go to angermanagement classes for a year at his cost. Include a very public apology! That will take the fight right out of that red faced drunkard!
Angry, violent and stupid. One can only hope that when this video is played in court that he feels embarrassed. And it’s too bad that this sort of thing drags its way into politics. I would hope that a lot of Trump supporters aren’t like this, but if you are like this who else would you support?
Really, what an arrogant, bullying liability. Is this guy mad or just deeply stupid. Using his car as a threatening weapon he deserves to be banned from driving. Perhaps walking along the public highway will cure him of delusions of owning it, and might enable him to lose a little of that unnecessary bulk.
He would have been K.O.’d, put into the back of his SUV and driven far away, stripped naked and left to find his own way back. Now that is justice. Now he will be arraigned and put on probation if it is his first violation. A smack on the wrist and an anger management class will be what he gets. LOL, he should be made to help the photographer for 20 hours as community service as well.
Sharing an opinion is one thing, attacking someone by name calling or lumping a group of people because of one guy is childish. With that being said, if you do want Hillary in office you may need a psychological evaluation. It may support your future insanity plea.
Because of the nature of rage, it is easy to take sides in this event. Permits and proper location scouting may have prevented this. Maybe the young photographer did this, I don’t know. It is very clear the photographer/s were quite cool under the circumstances. Politics and road rage aside for moment, looking at this as a photographer, you gotta do your due diligence. Clearly one never expects the sudden appearance of the Inland Empire lunitic fringe, but if you are shooting a job and the client is with you or the owner of the Audi you are shooting is with you. You have a resonsibility to them, for that remote possibility. When a spring-loaded angry Mr. Gordon materialzes out of nowhere and is bent on a fight because he believes you are on his property (right or not has nothing to do with his beliefs, as he clearly demonstrated) …well you can kiss that client goodbye. While the video of all this makes for dramatic internet content, and Mr. Gordon will have to live with this as his 15 minutes of fame (congratulations to you Mark) as well as going on a payment plan with his lawyers for the next several years; there is a distinct possibility that this may have been prevented and it is on the photographer. This piece is so incomplete it is laughable. As is the norm with today’s reporting, virtually every relevant question regarding the event- with exception of those supporting the favored party- goes unanswered…….or even acknowledged.
1. Is it legal to set up a photo shoot on a public road in this county or state?
2. If not, and I assume it is not, did the photogapher obtain, or even research, need for a permit?
3. Was the driver referring to the road as his “driveway” because the road is the only way to access his property? if so, is it entirely unreasonable for him to think of the road as an extention of his driveway? Would not most folks feel the same way?, even if they, personally, are better able to control their temper?
4. Is this a popular spot for such photo shoots? Are local landowners frequently inconvenienced by this sort of thing?
It appears there is nothing new here: one jerk’s behavior triggers an adverse response from another, albeit less temperamental, jerk…….Feces and stink, two things that have gone together since the beginning of time.
